Abstract:
The Criminal Justice and Immigration Act 2008 has made the aim of preventing offending and re-offending the principal consideration when sentencing young offenders. Whilst the welfare of the young person needs to be considered, welfare needs are now subordinate to the central aim of 'preventing offending'. This article examines the downgrading of the primary of the welfare of the young offender and considers the impact of this change on youth justice law and policy.
